Agreement to Terms
Welcome to Terrabyte Green (“we,” “us,” or “our”). By accessing or using our website at terrabyte.green (the “Site”), creating an account, purchasing products, enrolling in courses, or using any of our services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our Site or services.
We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms on this page with a new “Last Updated” date. Your continued use of the Site after changes are posted constitutes acceptance of the modified Terms.
About Terrabyte Green
Terrabyte Green is a 501(c)(3) nonprofit organization based in Fayetteville, North Carolina. We provide:
- Digital literacy training and education
- Refurbished technology devices
- E-waste management and IT asset decommissioning services
- Educational courses and resources
- Community programs focused on digital equity
Eligibility and Account Registration
Age Requirements
You must be at least 13 years old to create an account on our Site. If you are under 18 years old, you must have permission from a parent or legal guardian to use our services and make purchases.
Account Creation
When you create an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
You are responsible for maintaining the confidentiality of your account credentials. We are not liable for any loss or damage arising from your failure to protect your account information.
Account Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, for:

- Fraudulent, abusive, or illegal activity
- Providing false or misleading information
- Any conduct that we determine, in our sole discretion, is harmful to our organization, other users, or third parties

Purchases and Payments
Product and Service Purchases
When you purchase products or services through our Site, you agree that:
- All product descriptions, images, and specifications are provided for informational purposes and may not be completely accurate or current
- Prices are subject to change without notice
- We reserve the right to limit quantities or refuse service to anyone
- All sales are subject to product availability
- Payment must be received before products are shipped or services are provided
Refurbished Technology
Many of our devices are refurbished. By purchasing refurbished technology, you acknowledge that:
- Devices may show minor cosmetic wear consistent with prior use
- All devices have been tested and meet our quality standards
- Devices are sold “as-is” with the warranties explicitly stated at the time of purchase
- Specifications and condition grades are provided in good faith but may vary slightly
Payment Processing
We use third-party payment processors (such as PayPal) to process transactions. By making a purchase, you agree to:
- Provide valid payment information
- Pay all charges at the prices in effect when you place your order
- Pay all applicable taxes
- Be bound by the payment processor’s terms and conditions
We do not store complete credit card information on our servers. Payment card information is handled securely by our payment processor in accordance with PCI-DSS standards.
Order Confirmation and Acceptance
Receipt of an order confirmation does not constitute our acceptance of your order. We reserve the right to refuse or cancel any order for any reason, including:
- Product or service unavailability
- Errors in pricing or product descriptions
- Suspected fraudulent or unauthorized transactions
- Issues identified by our payment processor
If your order is canceled after your payment has been processed, we will issue a full refund.
Shipping and Delivery
Shipping Policy
- Shipping costs are calculated at checkout based on destination and shipping method
- We ship to addresses within the United States
- Delivery timeframes are estimates and not guaranteed
- Risk of loss and title for products pass to you upon delivery to the carrier
- We are not responsible for delays caused by shipping carriers, weather, or other circumstances beyond our control
Damaged or Lost Shipments
If you receive a damaged product or your shipment is lost:
- Contact us at support@terrabyte.green within 7 days of delivery (or expected delivery date for lost packages)
- Provide your order number and photos of any damage
- We will work with you to resolve the issue through replacement, repair, or refund
Returns and Refunds
Return Policy
Physical Products:
- Returns accepted within 30 days of delivery
- Products must be in original condition with all accessories and packaging
- Return shipping costs are the responsibility of the customer unless the return is due to our error or a defective product
- Refurbished devices must be returned in the same condition as received
Digital Products and Course Enrollments:
- Generally non-refundable once access has been granted
- Exceptions may be made at our sole discretion within 7 days of purchase if no significant portion of the content has been accessed
Services:
- Services rendered are non-refundable
- Cancellations must be made at least 24 hours before scheduled service appointments
Refund Process
To request a return or refund:
- Contact us at support@terrabyte.green with your order number
- Explain the reason for your return
- Await our return authorization and instructions
- Ship the product back to us (if applicable)
Refunds will be processed within 10 business days of receiving returned products. Refunds will be issued to the original payment method.
We reserve the right to deny refunds for:
- Products returned after 30 days
- Products not in original condition or missing components
- Products showing signs of use beyond normal inspection
- Abuse of our return policy
Course Enrollment and Access
Course Access
When you enroll in a course through LearnPress, you receive:
- Non-exclusive, non-transferable access to course materials
- Access for the duration specified in the course description (if applicable)
- The right to view and download course materials for personal educational use only
Course Content Usage
You agree that you will:
- Use course materials solely for personal, non-commercial educational purposes
- Not share your account credentials or course access with others
- Not reproduce, distribute, or create derivative works from course materials without written permission
- Not record, screenshot, or redistribute course content
Course Completion and Certificates
- Completion certificates are awarded upon meeting all course requirements
- Certificates are for informational and educational purposes only
- We do not guarantee that certificates will be accepted by employers, educational institutions, or licensing bodies
- Certificates may be revoked if we determine you violated these Terms
User-Generated Content
Comments and Community Posts
Our Site allows users to post comments and participate in community discussions. By posting content, you:
- Retain ownership of your content
- Grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display your content in connection with operating our Site
- Represent that you have the right to post the content
- Agree not to post content that is illegal, defamatory, harassing, threatening, or violates any third-party rights
Content Moderation
We reserve the right to:
- Monitor, edit, or remove any user-generated content
- Moderate comments and community discussions
- Remove content that violates these Terms or is otherwise inappropriate
- Take action against users who repeatedly post inappropriate content
We do not pre-screen user content but will respond to reported violations. While we moderate on a case-by-case basis, some user content may contain profanity or mature themes. Parents and guardians should monitor children’s participation in community features.

You may not post content that:

- Costs of procurement of substitute goods or services

- Errors, interruptions, or delays in service
- Actions or omissions of third-party service providers

- Failure to back up your data or content

Dispute Resolution
Governing Law
These Terms are governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles.
Jurisdiction and Venue
Any legal action or proceeding arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Cumberland County, North Carolina. You consent to the personal jurisdiction of these courts and waive any objection to venue.
Informal Resolution
Before filing a claim, you agree to contact us at privacy@terrabyte.green to attempt to resolve the dispute informally. We will work in good faith to resolve disputes amicably.

If you choose to include arbitration:
Any dispute, claim, or controversy arising out of or relating to these Terms shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except where prohibited by law.
- Arbitration will take place in Cumberland County, North Carolina
- The arbitrator’s decision is final and binding
- You waive your right to a jury trial
- You waive your right to participate in a class action
Small Claims Exception: Either party may bring an individual action in small claims court.
Class Action Waiver
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTE WILL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE ACTION. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
Miscellaneous Provisions
Entire Agreement
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Terrabyte Green regarding your use of the Site and supersede all prior agreements and understandings.
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.
Waiver
